Terms of Use

Eleviy is an AI-assisted fitness and nutrition product owned and operated by Svorus Private Limited, a company incorporated in India ("Eleviy," "we," "us," or "our"). The Eleviy app is available on Android (Google Play Store) and iOS (Apple App Store). The Eleviy website is available at eleviy.com.

By downloading, installing, or using the Eleviy app, or by accessing the Eleviy website or any Eleviy-related service, you agree to be bound by these Terms of Use. If you do not agree to these terms, you must not download, install, access, or use Eleviy.

We may update these Terms from time to time. The updated date and version number at the top of this page identify the current version. We will notify users of material changes through the app, the website, or email where required. Continued use after a change is posted constitutes acceptance of the updated terms.

You must be at least 13 years old to use Eleviy. If you are between 13 and 17 years of age, you must have the permission of a parent or legal guardian before creating an account or using the product, and that parent or guardian agrees to these Terms on your behalf.

Users under 13 must not use Eleviy. If we discover that a user under 13 has created an account, we will delete that account and associated data.

By using Eleviy, you represent and warrant that (a) you are at least 13 years old; (b) if you are between 13 and 17, you have parental or guardian consent; (c) you have the legal capacity to enter into these Terms; and (d) you are not located in a country subject to government sanctions that would prohibit you from using Eleviy.

You are responsible for maintaining the confidentiality of your account credentials, including your email address, password, and any social sign-in tokens. You are responsible for all activity that occurs under your account.

You agree to use a strong, unique password and to log out of shared devices after use. If you suspect unauthorized access to your account, contact us immediately at info@eleviy.com.

You must provide accurate, current, and complete information during registration and onboarding. Providing false information, including false health or fitness data, may result in inaccurate coaching and may lead to account suspension or termination.

You may not share your account credentials with others, create accounts for others without their consent, or use another person's account without authorization.

ELEVIY IS NOT A MEDICAL DEVICE, HEALTHCARE PROVIDER, OR LICENSED HEALTH PROFESSIONAL. THE CONTENT, COACHING, MEAL ESTIMATES, WORKOUT RECOMMENDATIONS, READINESS INSIGHTS, CYCLE-BASED NOTES, TDEE ESTIMATES, AND ALL OTHER INFORMATION PROVIDED BY ELEVIY — INCLUDING CONTENT GENERATED BY THE AI COACH (ARIA) — ARE FOR GENERAL WELLNESS AND EDUCATIONAL PURPOSES ONLY AND DO NOT CONSTITUTE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT.

You must consult a qualified, licensed physician, dietitian, nutritionist, or other relevant healthcare professional before starting any new fitness program, making significant changes to your diet, taking supplements, or making any health-related decision — particularly if you have any pre-existing medical condition, injury, chronic illness, eating disorder, history of disordered eating, diabetes, cardiovascular condition, pregnancy, or postpartum condition, or if you are taking any prescription medication.

Do not use Eleviy in place of professional medical care. If you experience pain, dizziness, shortness of breath, chest pain, fainting, or any other concerning physical symptom during or after exercise or a dietary change, stop immediately and seek medical attention. In an emergency, call your local emergency services number.

Eleviy does not guarantee any specific health outcome, weight loss, muscle gain, body composition change, or fitness improvement. Individual results vary based on many factors outside Eleviy's control.

AI-generated content including coaching messages, meal analysis, workout plans, readiness insights, weekly reports, and recommendations from the AI coach (Aria) is produced by machine learning models and may be incomplete, inaccurate, outdated, or not appropriate for your individual circumstances.

You are solely responsible for evaluating AI output before acting on it. AI content is not a substitute for professional medical, nutritional, fitness, or psychological advice. You should not rely solely on AI output for any health or fitness decision.

Eleviy makes no warranty that AI output will be accurate, complete, or free from errors. We reserve the right to modify, retrain, replace, or discontinue AI features at any time without notice.

Do not share personally identifiable financial information, passwords, emergency health information, medication details, or other highly sensitive personal information through the AI chat.

Eleviy offers optional paid Premium subscriptions through in-app purchases. In the Android app, Premium subscriptions are purchased through Google Play and entitlement management is supported by RevenueCat. In the iOS app, subscriptions are purchased through Apple in-app purchase systems where available. Eleviy does not use an external web checkout inside the Android app for digital Premium features.

Premium may include higher or unlimited limits for AI meal photo logging, AI coach messages, progress photo analysis, weekly AI reports, voice meal logging, adaptive workout plan generation, priority AI response speed, early access to new features, and priority support, as described in the app at the time of purchase. The exact benefits, limits, plan names, and availability may vary by platform, country, app version, trial eligibility, and active store configuration, but the plan selection and store purchase screens will identify the offer before purchase.

Monthly and annual plans may be available. Google Play or the App Store displays the final local price, applicable taxes, billing period, renewal terms, and any eligible trial, introductory offer, or promo benefit before you confirm purchase. If a free trial or introductory offer is available and you do not cancel before the trial or introductory period ends, the subscription may convert to a paid auto-renewing subscription according to the terms shown by the app store.

Auto-renewing subscriptions renew automatically until cancelled. To stop future renewals, you must cancel through the applicable app-store subscription management process before the renewal date. The Eleviy app provides a manage or cancel link in the Premium or account settings area for Google Play subscriptions, and you can also manage Google Play subscriptions at https://play.google.com/store/account/subscriptions.

Cancelling a subscription stops future renewals. Unless Google Play, Apple, or applicable law provides a different remedy, cancellation does not provide a refund for the current billing period and Premium access normally continues until the end of the current billing period. Refund requests and charge disputes are handled under the applicable app store rules and applicable law.

Plan changes, billing issues, grace periods, account holds, pauses, restorations, refunds, and entitlement updates are handled according to the applicable app-store rules and the entitlement status received from Google Play, Apple, or RevenueCat. Premium access may continue, downgrade, pause, or end based on that entitlement status.

Deleting the Eleviy app, logging out, or deleting your Eleviy account does not automatically cancel an active Google Play or Apple subscription. If you request account deletion while a subscription is active, you remain responsible for cancelling the subscription through the applicable app-store subscription management process to avoid future renewals.

Eleviy does not store full payment card numbers, CVV codes, bank account credentials, or app-store payment credentials. Payment processing is handled by Google Play, Apple, or the applicable app-store billing provider. Eleviy receives entitlement and transaction-status records needed to provide Premium access, restore purchases, prevent fraud and abuse, support users, and satisfy legal, accounting, tax, refund, dispute, and audit obligations.

Promo codes, bonus access periods, free trials, introductory offers, and special offers are subject to the specific eligibility and offer terms stated in the app and app-store purchase flow at the time of redemption. Unless expressly stated, they cannot be combined, transferred, exchanged for cash, or applied retroactively.

The Eleviy app, website, and all content — including text, graphics, logos, icons, images, software, and the Eleviy brand — are the property of Svorus Private Limited or its licensors and are protected by applicable intellectual property laws.

Eleviy grants you a limited, non-exclusive, non-transferable, revocable license to use the Eleviy app on your personal device solely for your personal, non-commercial fitness and nutrition purposes in accordance with these Terms.

You may not copy, modify, distribute, sell, license, reverse engineer, decompile, disassemble, or otherwise attempt to extract the source code of the Eleviy app or website. You may not use the Eleviy name, logo, or branding without our prior written consent.

You retain ownership of the personal data and content you upload to Eleviy (such as photos, meal entries, and workout logs). By uploading content to Eleviy, you grant Svorus Private Limited a limited, royalty-free, worldwide license to store, process, and display your content solely for the purpose of providing the Eleviy service to you.

AI-generated coaching responses and reports are provided as part of the Eleviy service. You may use them for your personal wellness purposes but may not republish or commercialize them without our consent.

You agree not to use Eleviy for any unlawful purpose or in any manner that violates these Terms.

Prohibited conduct includes: attempting to access another user's account or data; scraping, crawling, or extracting data from Eleviy in an unauthorized manner; introducing viruses, malware, or other harmful code; attempting to interfere with or disrupt the security or performance of Eleviy's servers, networks, or services; using Eleviy to transmit unsolicited commercial messages (spam); impersonating any person or entity; submitting false, misleading, or fraudulent information; violating any applicable law or regulation; and using Eleviy to harass, abuse, or harm any person.

We reserve the right to investigate any suspected violation and to take appropriate action, including suspending or terminating accounts.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ELEVIY AND SVORUS PRIVATE LIMITED, INCLUDING THEIR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS, SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES — INCLUDING LOST PROFITS, LOSS OF DATA, LOSS OF GOODWILL, PERSONAL INJURY, OR PROPERTY DAMAGE — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE ELEVIY APP, WEBSITE, OR ANY CONTENT OR FEATURE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF ELEVIY SHALL NOT EXCEED THE AMOUNT YOU PAID TO ELEVIY IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR INR 1,000 (ONE THOUSAND INDIAN RUPEES), WHICHEVER IS GREATER.

ELEVIY IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, NON-INFRINGEMENT, OR UNINTERRUPTED AVAILABILITY.

The limitations in this section apply to the fullest extent permitted by applicable law in your jurisdiction. Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Svorus Private Limited, Eleviy, and their officers, directors, employees, agents, affiliates, licensors, and service providers from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) your use of or inability to use Eleviy; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) any content you submit, upload, or transmit through Eleviy; or (e) your infringement of any third-party rights.

We reserve the right to suspend, restrict, or terminate your access to Eleviy at any time, with or without notice, if: (a) you violate these Terms or any applicable policy; (b) we reasonably suspect fraudulent, abusive, or harmful activity on your account; (c) required by law or regulation; or (d) for any other reason at our discretion.

You may close your account at any time through Settings > Danger Zone > Delete Account in the app, or by contacting info@eleviy.com. Closing your account will not cancel an active subscription, which must be cancelled separately through the relevant app store.

Provisions of these Terms that by their nature should survive termination — including sections on medical disclaimers, intellectual property, limitation of liability, indemnification, and governing law — will survive termination of your account.

These Terms of Use and any dispute arising out of or relating to these Terms or your use of Eleviy shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or validity thereof, shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, it shall be submitted to binding arbitration or, if arbitration is not available, to the courts of competent jurisdiction in Bangalore, Karnataka, India.

You and Eleviy each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

If you are a consumer in a jurisdiction where mandatory consumer protection laws apply, nothing in this section limits your rights under those laws.

Eleviy may link to or integrate with third-party websites, services, and platforms including Google Play, Apple App Store, Google Sign-In, Apple Sign-In, and AI service providers. These third-party services have their own terms of service and privacy policies, which you should review separately.

Eleviy is not responsible for the content, practices, or policies of any third-party service. Linking to a third-party service does not imply endorsement.

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, the remaining provisions will continue in full force and effect.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

These Terms, together with the Privacy Policy, Data Deletion page, and any other applicable policies, constitute the entire agreement between you and Svorus Private Limited regarding your use of Eleviy and supersede any prior agreements.
